AITAH for asking my ex husband's ex wife for money from her parents' estate for my son?

I know my title is confusing. I will clear it up before I continue. I was married to Mark and we have a son whom I will call Dan.
  • 03
We divorced when Dan was ten. Two years later he married Rita. She had a daughter from a previous relationship.
  • 04
Call her Abby. Eight years later Mark and Rita divorced. I hope that clears up the relationships.
  • 05
Last year Mark passed away. He was young and it was a terrible accident. I didn't love him any more but he was a good man and a fantastic father to our son.
  • 06
He left Dan everything. Dan would much rather have his father back than this money. But he is in his twenties and this gift can set him up for life.
  • 07
Not support him forever. But he will be debt free and a homeowner much sooner than planned.
  • 08
Rita seems to think that some of that money should go to Abby. The will was clear.
  • 09
All of Mark's estate goes to Dan. I don't get anything. I'm fine with that. We divorced amicably and I was satisfied with our division of assets.
  • 10
I have also remarried and my husband and I are comfortable. Rita says that because Mark was a father figure for Abby she should have gotten money as well.
  • 11
The will is ironclad. Neither Rita or Abby get anything. Abby's father is in the picture and paid child support and is an active part of her life.
  • 12
Rita recieved money when her parents passed away. She also got money when she divorced Mark.
  • 13
I asked to meet with Rita to settle this without lawyers. I said that she needed to give Dan some money that she got from her parents.
  • 14
It would only be fair since she was Dan's stepmom and she hadn't contributed to his education or anything
  • 15
She said I was being ridiculous and that it wasn't the same. I said she was asking for money for a child that wasn't blood related to Mark.
  • 16
was asking for money for a child that wasn't blood related to her. It was exactly the same.
  • 17
She says I'm being an asshole and that my view of the situation is stupid. She thinks, even though Mark's will is legal and clear, that morally Dan should share with Abby.

I just repeated that morally she should give Dan money since she has financially supported Abby.
  • 20
I hope that was clear enough so you guys can say if I am right or not.

StrangelyRational He's an adult. Is there any reason he needs your help here? Has he asked for it?
  • 24
Odd-Currency5145 Original Poster's Reply She was in his life for eight years. She knows how to manipulate him. And yes he asked me to help. My very first suggestion was for him to get a lawyer.
  • 25
Aquapele "To settle it so lawyers"- settle what? There is literally nothing to discuss here. If your son is the over 18 beneficiary, it isn't even a bone she can pick with you. You have no say here- it would be Dan's decision. "No" is a complete sentence.

Odd-Currency5145 Original Poster's Reply I know. But she is getting aggressive.

Budget_Computer_427 Leaning towards ESH. No need to make analogies to this woman, just block her and move on with your life.

Odd-Currency5145 Original Poster's Reply I'm trying to insulate my son from her. She was in his life for eight years and is trying to manipulate him emotionally.
  • 29
ronhaha108 Are you presenting this to the stepmom to prove the point that it's the same ask or legitimately requesting the step son get part of that estate? I assume it's about proving the point but don't think it's clear.

Odd-Currency5145 Original Poster's Reply Just to make a point.

asafeplaceofrest I hope you are just being facetious with Rita. In any case, even if you wanted to, I don't think you legally can give her what she wants. Dan's money is not yours to give away. If he wants to, he can give Abby money, but don't whisper that in Rita's ear. I don't know how to rate you, but Rita is definitely an AH. Tell Dan that he doesn't owe Rita anything.
  • 32
Odd-Currency5145 Original Poster's Reply I have no say in this at all. I was just trying to make her understand. Abby has two parents that she will inherit from some day. As does Dan. That is all I was trying to get across.

propaneandbandaids NTA - but stop the communication. Seriously. She is gonna record you and you will end up giving her a foothold to sue over. She won't win, but you will still have to hire a lawyer if you insist on continuing the dialogue.

No-Divide-1234 Not the a hole, I'm not sure where this idea come from that mixed family kids all deserve equal especially after a divorce. If Mark wanted her to get money it would have been in the Will. Dan owes step sister nothing.
  • 35
BG3restart NTA. Abby still has two living parents to provide for her. She has no claim on Dan's money.
  • 36
Vestiel NTA - she made a ridiculous claim and when faced with the same exact situation she was defensive. The only thing you could do better is ask if she has put in her will anything for Dan. That'd be a slightly better argument.
